I HAVE proof that even when the poice had actual video evidences of gay anal sex between two men, they did not charged them with 377A. A friend of a friend of mine (lets call him J) had his place searched because of some illegfal activities. Besides finding what they want, they also found p o r n, AND private videotapes of of J having anal sex with his lover, which they filmed themselves. J was later charged in court for possessing p o r n. He was never charged with 377A. However, he was interviewed and asked about those private videotapes which he readily admitted was him and his lover.

Initially, J was so afraid he was going to be thrown in prison for a long time because of 377A. However, he was never charged with that but eventually had to pay a hefty fine for posession of p o r n.

Our government is not perfect. However, where 377A is concerned, lets take their words when they said they will not use it against us for private consensual gay sex. So far, for many years they had not. If they did, they will be going against the promises given to us by both the MM and the PM. And that in itself, for the 50 years that I have been a citizen here, is something almost cast in concrete.

In this case, the 46 years old HIV+ man having oral sex with a 16 years old boy in a shopping centre toilet, he was charged with 377A. My personal feelings are : 1) He did it with someone almost juvenile. Even in our own forum here, we declared ourselves out of bound to anyone under the age of 18. 2) He did it at a public place.

The police had been consistent. If you did it with someone very young or did it with someone at a public place, they will throw the book at you.

Bishan lensman draws Net talk

They focus on his eccentric behaviour in taking photos, said to be of young people

PART-TIME tutor Daniel Cheng is a familiar face at fast-food outlets in Bishan's Junction 8 mall.The 46-year-old is the man seated at one end of the restaurant, be it KFC or McDonald's, for hours on end. His reverie is broken occasionally when he picks up his camera phone and appears to train it on the restaurant patrons.

His antics have not gone unnoticed.

Marcus Lin, 17, from the nearby technical institute, who hangs out at the mall, said: 'We try to avoid him. Everyone here knows him. He's always there, listening to his CD player and taking pictures with his (mobile) phone.'

Mr Cheng has attracted no small measure of Internet infamy as well, with numerous blogs giving details of his eccentric behaviour. There are even videos posted on YouTube of him in action, which attracted close to 1,000 eyeballs.

The comments are hardly flattering, with netizens, mostly students, giving him the moniker 'Bishan gay' because of his odd behaviour.

When The Straits Times caught up with him late last month, the stocky man covered his mouth with his hands and chortled when told about the blogs.

'I'm not aware of these at all, I'm not a celebrity. I never read blogs because they are not examples of true objective journalism,' he said. Not once did he ask about what was written about him online. Nor was he curious to find out who the bloggers were.

Even when told of what had been said about him and his anointed nickname, Mr Cheng, who is single, did not bat an eyelid. Dismissing it with a wave of his hand, he said he was not bothered by the accusations because they were all 'untrue'. 'I'm not a celebrity or anyone famous. What can I do about them anyway? A lawsuit costs a lot of money and it takes a few years before it can be completed. By the end of it, I will be so drained.'

He was told that people could be discomfited by his behaviour of snapping pictures and recording videos of strangers.

No, that could not be the case, Mr Cheng insisted. 'I am taking pictures of only Bishan's scenery. I love Bishan and I feel very attached to the place, which is why I still come back here after moving to Ang Mo Kio,' he said.

Another reason: He said he is attached to his alma mater, Raffles Institution (RI), which moved from Grange Road to its present Bishan campus in 1990.

When contacted, RI deputy headmaster Kenneth Kwok said the school was aware that the boys knew of Mr Cheng.

'We do not encourage our boys to engage in any name calling. We also emphasise to our boys the need for personal safety when they interact with any strangers,' he said.

Mr Cheng claimed to know many RI boys, attending alumni functions and fund-raising fun fairs. He is often seen wearing T-shirts linked to the school. 'I feel responsible for these boys, and I just want to guide and help them if they need it,' he said, when asked why he was still so involved with the school after so many years.

No one, he said, had ever told him off to his face.

That might be the case, but talking behind his back is a favourite pastime of those in the area.

The Straits Times observed him for nearly six hours on a Tuesday starting from 10am till about 4pm, at a fast-food outlet at Junction 8 mall and on bus service 156. He seemed oblivious to the attention he attracted.

Some teenagers gave him a wide berth at the restaurant. Others pointed him out to their friends and spoke in hushed voices about how he was always hanging around in the area. Some even chided their friends for sitting near him.

Andrew Chan, 16, was one of the students who spotted him at Bishan and told the two friends he was with to sit far away from the man.

If Mr Cheng was aware of the students' discomfort, he did not show it.

That Tuesday, he snapped pictures with his camera phone while in the restaurant - where he sat for four hours nursing two cups of tea. He then headed to the nearby coffee shop, for about 20 minutes, where he had lunch and carried on taking more photos.

He boarded bus service 156 outside Bishan MRT, got off three stops later near Mount Alvernia Hospital and crossed the road to the bus stop by MacRitchie Reservoir. Here he spent half an hour before taking the same bus service again, this time, in the opposite direction, taking snapshots both at the bus stop and on the packed bus full of students from RI and Hwa Chong Institution.

After alighting in Ang Mo Kio, he was last seen crossing the road once more for the opposite bus stop. Altogether, The Straits Times saw him take at least 19 photos during the day.

He certainly got an eyeful of Bishan.

Singapore: 3 men sent to reform centre for beating male “flasher” to death

In the first known case of its kind in Singapore, six men have appeared in court for beating a man - who allegedly exposed himself and offered sexual favours - to death.

Three men, two aged 17 and one aged 20, who along with three other men who beat a 37-year-old man to death after he allegedly offered two of his attackers oral sex in a public toilet.

An Oct 8, 2008 report in Today newspaper. Located on Singapore's main shopping street, Orchard Towers is known infamously as ''Four Floors of Whores'' where commercial sex workers meet potential clients.

The Straits Times on Wednesday reported that Muhammad Ridhwan Mohd Roslan, 20, Ho Ching Boon, 17, and Lai Chee Kuen, 17 – have been sentenced on Tuesday to be confined for between 18 months and three years at a reformative training centre. They will undergo a regimen of foot drills, counselling, education and vocational training.

The remaining three - Ahmad Nur Helmy Ahmad Hamdan, 20, Muhammad Sufian Zainal, 21, and Helmi Abdul Rahim, 28 - will be sentenced on Nov 6.

According to earlier media reports, 37-year-old Suhaimi Bin Sulong clashed with his attackers in the early hours of Nov 23 at Orchard Towers where he sustained blunt force injuries to his head and neck. He was taken unconscious to the Singapore General Hospital and was pronounced dead an hour after.

Although the six had been charged with the murder shortly after the incident, the charges were downgraded to that of voluntarily causing grievous hurt to which all six pleaded guilty early this month.

Citing court documents, the media reported that the men had gathered at a pub at Orchard Towers on the evening of Nov 22 to celebrate a friend's birthday. Lai and Ho said they were approached by the Suhaimi who asked them if they wanted oral sex which they declined.

At about 4am, Suhaimi allegedly approached and indecently exposed himself to Ahmad Nur Helmy while they were in the toilet. Angered, Ahmad summoned his friends - Muhammad Sufian, Ho and Lai - and they confronted the victim and asked if he was a homosexual.

The Times reported that when Suhaimi ignored him, Ahmad punched him in the face till he fell onto the floor as Muhammad Sufian restrained Ahmad and helped Suhaimi up onto his feet.

Suhaimi tried to flee but was kicked in the back by Muhammad Sufian who had earlier helped him. He was then attacked by Ahmad, Muhammad Sufian, Ho and Lai. Muhammad Ridhwan and Helmi, who were bystanders, then joined in.

The remaining three face imprisonment of up to 10 years, and may also be fined or caned.

That is why I said taking away somebody life is wrong. Our law is fair for this instance. They are being punished for voluntary homicide. Bear in mine, he has outrage the modesty of the other guy. In their anger, he and his friends had involuntary beaten the guy and causing his death. Based on your encounter, i wonder why such people are still around, pestering hard for fun in public places, especially sex can be easily availabe in the saunas and internet chat room nowadays. What sort of thrills were they seeking ? Exhibitionism? JO ? Oral ? I dun think anal sex can be easily performed in crowded public toilets. More gays seek help for relationship problems

THEY have little support in the wider community.

So, more people in same-sex relationships are seeking help from professional counsellors.

This is the observation of five counsellors interviewed by The New Paper.

One counsellor, who declined to be named, said he has seen a growing number of same-sex couples, mostly gay men, seeking help in their relationships.

Gay men in a relationship might argue about gender roles.

One may be the breadwinner while the other does housework at home.

The breadwinner might then ask the homemaker: 'Why am I the only one earning money?'

The counsellor said: 'In same-sex couples, they have to negotiate the gender roles, as they have no models to follow. They need to create a different set of rules.'

Another counsellor said that a year ago, a gay male client in his 20s came for counselling partly because of relationship troubles.

Depressed and tearful

He was depressed, suffered from crying spells and could sleep only for three to four hours a night.

He had been dating another man, also in his 20s, for about a year. But he felt insecure about the relationship because his partner liked to go to parties, while he spent most of his time at home.

The two didn't live together, and the client felt his partner wasn't spending enough time with him. They hadn't had physical intimacy for months.

The client was broken-hearted because he felt he wasn't attractive enough to his partner, and felt the latter wanted to see other men.

To rub salt into the wound, the client was supporting his partner's expensive lifestyle, as the client was a well-educated professional, who earned more money than the latter.

But the client felt he couldn't tell his problem to either his family or his colleagues, because they didn't know he was gay, and he was afraid to disclose his sexual orientation.

He also didn't share his problem with the handful of gay friends he had.

'That's how the client ended up talking to me,' the counsellor said.

The counsellor didn't want his client or himself to be named to protect counsellor-patient confidentiality, but said he sees about two homosexual clients a month.

Similar feelings

The counsellor said: 'The problems which my client faced - feelings of inadequacy and insecurity - are quite similar to those experienced by heterosexual couples.

'But unlike opposite sex couples, my client didn't have much family or peer support to fall back on.'

Mrs Juliana Toh, clinical director of the Counselling and Care Centre, is also seeing more same-sex couples.

Her centre saw about 10 same-sex couples last year. Five years ago, she would see at most one a year.

She believes there are more people in same-sex relationships coming for counselling because there are more gay-friendly services available, compared with 10 years ago.

She added: 'It's like with divorce. Gay people today are less marginalised, although they still have to look very carefully for who they share their problems with.'

The fact that both parties are of the same gender does influence the dynamic in same-sex relationships, she said.

Mrs Toh noted that lesbian relationships are more stable than those between gay men, because women tend to be better at communicating their emotional needs to their partners.

Six men in Singapore have been charged under Sections 377 and 377A for having sexual relations with a 15-year-old male teenager.

Singapore's Mandarin-language daily LianHe Zaobao (联合早报) reported today that the six men were charged last Thursday for sexual acts against the order of nature and gross indecency with the same 15-year-old boy in 2006 and 2007. It is not known when the men will be sentenced.

The paper reported that the six accused persons got to know the student on the Internet. It further explained that the men were charged under the old Section 377 as some of the offences occurred before the Penal Code (Amendment) Act took effect on Feb 1, 2008.

Under the old statute which has since been repealed, Section 377 criminalises any person who "voluntarily has carnal intercourse against the order of nature with any man, woman or animals." The new Section 377 criminalises necrophilia.

Wu Jingwei, aged 50, and Balasunderam are each charged for an offence under Section 377. If convicted, they face life imprisonment, or jail term of up to 10 years, and are liable to be fined. The report further mentioned Wu to be a former deputy director of the Central Narcotics Bureau, former chairman of the Singapore Amateur Social Dance Association, and former manager at concert organiser Unusual Productions.

Guo Fucheng and Song Juncheng were each charged under Section 377A of the Penal Code which criminalises "any act of gross indecency" between male persons. If convicted, they face up to two years of imprisonment.

Two other accused Hafasa and Huang Rongyou each face two charges under Section 377 and another two under Section 377A.

The report did not elaborate on the specific sexual activities between the men and the teen nor did it explain why the men were charged under different laws. It is however noted that the penalty under Section 377 is much more severe than 377A.

Currently, under Section 7 of the Children and Young Persons Act, any person who commits or abets the commission of any obscene or indecent act with any child or young person aged 15 or younger may face imprisonment up to two years and/or a fine up to S$5,000 for first-time offenders.

The new Section 376A of the Penal Code provides for more severe penalties with imprisonment of up to 10 years or with fine or with both for more serious sexual offences including oral and anal sex with minors under 16 years of age.

In October 2007, Section 377 which criminalised "carnal intercourse against the order of nature" between persons of non-specified gender was repealed as a result of a wide ranging Penal Code Amendment Bill. Section 377A which criminalises "any act of gross indecency" between male persons with a penalty of up to two years jail was however retained despite a high profile campaign by the gay community and Nominated Member of Parliament Siew Kum Hong. He tabled and presented a parliamentary petition signed by 2,519 Singaporeans and Singapore residents who support the repeal of Section 377A. ae

How did the police find out about this case? Did the 7 of them do it publicly or did the 15 year old guy report the others to the police? Kids nowadays goes online to look for sex. I remember I got message from some young kid asking me if I mind younger. I did not reply him.

The above case most likely came to light when the parents found out about the activities of their son and report it to the police. Police must have raided the computer and checked the boy's chat log and found those guys.

I think those who goes online looking for ONS should be careful of who they are meeting with online because I think many of the youngsters may, like what TB said, mask their age so as to gain access to some sites/chatroom.

Kids nowadays goes online to look for sex. I remember I got message from some young kid asking me if I mind younger. I did not reply him.

The above case most likely came to light when the parents found out about the activities of their son and report it to the police. Police must have raided the computer and checked the boy's chat log and found those guys.

I think those who goes online looking for ONS should be careful of who they are meeting with online because I think many of the youngsters may, like what TB said, mask their age so as to gain access to some sites/chatroom.

A SPORTS coach was charged in court on Friday with molesting four teenage boys and performing oral sex on one of them.

The 50-year-old, whose name is withheld to protect the identities of the victims, is claiming trial to six charges.

He allegedly molested his victims, aged 13 and 14, at various places between October 2006 and June 2007.

The man, who is represented by Mr Ignatius Joseph, is said to have committed unnatural sex on a 14-year-old boy in April 2007, two months after he allegedly molested him in a car.

Bail of $10,000 was set. The case has been adjourned to Mar 9.

If found guilty of molestation, he can be jailed for up to two years and/or fined.

The punishment for unnatural sex is a jail term of up to 10 years and a fine.

FIRST, a nude couple were caught on camera sauntering down a street at Holland Village.

Now, photos have emerged of two men engaging in sex acts in a lift and the area around the lift landing.

Posted on blogs since early this year, the indecent pictures show two naked men performing various sex acts.

The pictures are said to be screenshots taken from three video clips.

What they did in public is so lewd and so graphic that one could label them bad, bold and ugly.

The incident took place in a lighted lift and along the corridor at the lift landing - apparently in the dead of night.

No members of the public were spotted in the footage.

The authorities have confirmed that the lift belongs to a public housing block.

To be sure, such acts by perverse individuals are few and far between.

But some are asking if it is time for the majority to speak up, lest others start getting bolder.

Most people interviewed were outraged by the public nature of the men's acts of indecency.

Many netizens who saw the pictures were appalled by the audacity of the two men and disgusted by the graphic content.

Some said the men were sick in the head while others said the pictures were stomach-turning.

'I can't believe that this is happening in a HDB vicinity. I really don't understand these guys, what kind of thoughts are going through their minds? ' said one anonymous viewer.

However, some felt that these netizens were overreacting.

A site visitor who went by the name of Krado said: 'No one is forcing you to view (such) pictures.'

Bad name

Mr Jan Koh, 29, a manager, felt the pictures gave homosexuals a bad name.

'This is just one instance where two men break the law but people will see it as reflective of all homosexuals,' he said.

'It won't be fair that one act should stereotype all homosexuals as being exhibitionists.'

Several visitors to one of the blogs that posted the pictures requested for links to the video.

Lawyers said the men could be prosecuted under various sections of the Penal Code and one psychiatrist wondered if they wanted the thrill of doing it in public and getting away with it.

For many, the issue was that the sexual acts occurred in a public area, not so much the gender of the perpetrators.

A blog visitor by the name of Todoshi said: 'I think the main issue here is not about guys having sex. It's about guys having sex in public.

'I definitely do not want to see any form of sexual intercourse (no matter the gender) at my void deck.'

Mrs Wennie Chia, 31, was disgusted that the acts were performed at a public housing estate.

She said: 'Such things should only be done in discreet places, like a hotel room.

'It will be so wrong if a child were to witness it, adding to the fact that it's two men,' said the mother of a 3-year-old son.

Polytechnic student Ryan Chia, 18, felt these acts could not be condoned.

He said: 'The fact that it involves two men and in a public area makes it twice as bad.'

Others blamed the erosion of Asian values.

Businesswoman Rose Chomil, 46, said: 'Youngsters nowadays have become so influenced by Western culture that they think it's okay to do this in public, but it's not.

'As Asians, we should keep our tradition of being conservative and not become public with everything.'

Ms Chomil added: 'This is a housing area, with families walking around. The children may see this. The men should definitely be punished or shamed for doing such an act in public.'

All the people the New Paper spoke to said that they would be just as outraged if it had been a man and a woman.

Miss Cho Chui Wai, 26, an undergraduate, said: 'The issue here is not that they're gay. But rather, if they want to do something like this, get a room, don't use the lift or stairway landing.

'Even if they were heterosexuals, it's still gross. Imagine the shock of stumbling on them.'

Miss Cho said she would not confront them but would quickly walk away.

Others, such as Mr Teo Boon Keng, 47, said they would take action if they were to see such an act.

He said: 'I am more outraged that it happened in public than that it involves two men. If I see such a thing happening, I will definitely call the police as it is wrong to perform sex acts in public. They should be punished.'

Said Ms Cho: 'They are probably doing this for the thrill of it. If they dare to do such things in a public place, then they must be prepared to be caught.'

PERFORMING sex acts in public is illegal, said three lawyers contacted by The New Paper.

The men could possibly be identified as their faces can be seen in the video and this could aid in their prosecution.

Mr Luke Lee, 56, a lawyer in private practice, said the men could be charged for committing an obscene act in public, and could be jailed for up to three months, and/or fined under Section 294 of the Penal Code.

He said the incident in the lift was worse than appearing nude in public because of the public exhibition of sex acts.

He said: 'This incident goes beyond the hoo-ha about homosexuality. Even if a man and a woman had sex in public, it would be just as serious.'

However, a senior counsel, who declined to be named, said the men could still be charged under Section 377a of the Penal Code, which criminalises sex acts between men.

This is a more serious charge, and carries a jail term of up to two years.

Mr Pritam Singh Gill, a lawyer in practice for 20 years, said that if the video was posted online, they could be charged with distributing or circulating obscene material by electronic means.

If found guilty, they could be jailed up to three months, fined or both under Section 292 of the Penal Code.

He said the police have extensive powers under the Misuse of Computer Act to locate the perpetrators and establish their identities.

A police spokesman said: 'It is unclear from the limited information... which is lifted from a blogger's posting, where and when this incident took place.

'Without more details, it is not feasible for police to comment on the matter... If anyone has more information on this incident, they may lodge a police report at any Neighbourhood Police Centre.'

Ms Sheena Jebal, CEO and principal psychologist of NuLife Care and Counselling Services, thinks this incident shows that young people have got bolder.

She believes the video was taken for the personal consumption and sexual gratification of the two men, who might have done it for the thrill of performing the unthinkable in public and getting away with it.

'It is unlikely that anyone in Singapore would allow such personal videos to be released online,' she added.

However, Dr Carol Balhetchet, director of youth services at the Children's Society, believes the video was deliberately disseminated, and the men were trying to make a statement of bravado through it.

She said: 'They want to make an impact, to be known... They want to be caught, and to have people look at them.'

Dr Balhetchet said if the two men just wanted the thrill of having sex in public, they would have chosen a less open place, such as a stairwell, beach or park.

Dr Balhetchet suspects that there are underlying reasons for the men to commit such an act, and they ought to be made aware of the consequences of their actions, probably through therapy and counselling.
