There are increasing number of churches who recognize reality and move away from the falsity of calling homosexuality a "sinful way of life".

The five-day hearing will be presided over by Justices Chao Hick Tin, Chan Seng Oon and Woo Bih Li.

Prosecutors in Singapore were only asking for 10 years imprisonment for YangYin's case. 

And these guys are only getting a maximun of 8 years jail term.

It seems to be a really worthwhile professional deal to be a white collar criminal here in Singapore now.

SINGAPORE - Six City Harvest Church (CHC) leaders at the centre of a multi-million dollar financial scandal will return to face the courts on Thursday (Sept 15).

 

The marathon City Harvest trial begins again in the High Court, with both the defence and prosecution appealing.

 

The appeal will continue on Friday (Sept 16) and for the first three days of next week (Sept 19 to 21).

 

It will be heard by Judge of Appeal Chao Hick Tin, and Justices Woo Bih Li and Chan Seng Onn.

 
The six who have been convicted - including CHC founder Kong Hee, 52 - are arguing against their convictions and sentences, while the prosecution is appealing for longer deterrent sentences.
 

In October last year, the six were convicted of misappropriating millions in church funds to fuel the pop music career of Kong's wife, Ms Ho Yeow Sun, in a church mission known as the Crossover Project.

 
 
  
 

The court found that they had invested $24 million from CHC's building fund in bogus bonds from music production company Xtron and glass-maker Firna, and this money was in fact used to fund the Crossover Project.

Later, another $26 million was used to cover up the initial misdeed.

For their crimes, the six were handed jail terms ranging from 21 months to eight years.

Kong, singled out as the key man behind the scandal, was given the stiffest sentence.

Presiding Judge See Kee Oon had choice words for the charismatic church pastor, who he said "acted consciously and dishonestly".

"One does not need to be an expert in legality to appreciate certain fundamental aspects of honesty, truth and integrity," wrote Judge See in his written judgment.

Former CHC fund manager Chew Eng Han, 57, was handed a six-year term. And as Kong's right hand man, deputy senior pastor Tan Ye Peng, 43, was given a sentence of five and a half years.

 

Former church finance manager Serina Wee, 39, was given a five-year term. Former CHC finance committee member John Lam, 48, was sentenced to three years in jail.

 

Former church finance manager Sharon Tan, 40, received the shortest sentence of 21 months' jail.

 

Calling the case unique and without precedent, Judge See had agreed with the defence that the church suffered no wrongful loss, but still found them guilty of serious offences - including falsifying church accounts and breaches of trust involving large sums of charity money.

 

But the prosecution has described the jail terms as "manifestly inadequate". During the trial, they called for harsher sentences - highlighting that the case involved the largest amount of charity funds ever misappropriated in Singapore's legal history, which has shaken public confidence in the charity sector.

Deputy Public Prosecutor Christopher Ong said: "It must be made clear that those leading charities, entrusted with the funds, must adhere to the highest standards of integrity and transparency."

 

The session starting on Thursday could be the final avenue of appeal open to the six church leaders.

If their appeals fail, they can only refer the case up to the Court of Appeal with its permission - and only then if there is a point or question of law to argue.

In court on Thursday, Kong's lawyer Edwin Tong said all three of the pastor’s convictions for criminal breach of trust should be overturned.

Kong had never intended to cause wrongful loss to the church, and had put the monies toward the church’s mission which was supported by virtually the entire congregation, the senior counsel said. 

Mr Tong argued that Kong had not pocketed any of the S$50 million he has been convicted of misappropriating and that the church had not suffered any financial loss as a result of his actions. The prosecution is not disputing these facts.

In channeling millions of dollars of church funds toward his wife’s secular music career, Kong believed he was acting in the best interests of the church because Ms Ho’s career as a singer was synonymous with what is known as the Crossover Project – the church’s mission to reach out to non-Christians through pop music, the lawyer said.

He argued that even if the church’s monies had been “wrongfully used” to bankroll Ms Ho’s career, it did not mean that Kong had been dishonest. 

"It is beyond question that the accused believed wholeheartedly that they were using church funds for an approved church purpose," Mr Tong said. 

The lawyer also rubbished the allegation that Kong had intended to act dishonestly by using church monies to “secretly fund his wife’s career”, as prosecutors have alleged, saying Kong had consistently consulted auditors and lawyers on two bond investments, which Judge See had found to be sham investments.

Even if the investments were a sham, “every cent was used entirely for the church’s mission”, Mr Tong said. “Even if (the church’s funds – meant for investments or building-related expenses) were put to “wrongful use”, they were “applied in good faith” and caused no loss to the church, he added.

SINGAPORE: The High Court on Friday morning (Sep 16) heard the appeal of Chew Eng Han, who was sentenced to six years' jail last November for his part in misappropriating S$50 million of City Harvest Church funds.

 

Chew, who served as the church's investment manager, argued he should be acquitted because "there was no misappropriation". He said the sentencing judge had "gravely erred" in his ruling, and used a flawed definition of misappropriation.

 

Though Chew conceded that the S$50 million - set aside for the church’s investments and building-related expenses - had instead been channelled towards the secular music career of Sun Ho, he argued the sentencing judge had "automatically" assumed this was done dishonestly.

 

Chew said this cannot be the case, because "the church had not been deprived", but rather benefitted, from the channelling of funds toward "a church purpose" - Ms Ho's music career.

 

"The logic is Sun becomes a megastar, (holds more) concerts ... then she can evangelise,” Chew said, adding that he had attended two concerts himself and believed "100 per cent" in the Crossover Project, even donating S$1 million towards it.

 

Having done so, it is "illogical for me to want to cause loss to the church", he said.

 

Chew also told the court the funding of the Crossover Project had been "secret". This was not because the six conspirators knew or thought that it was illegal to use church funds in this way, but because "Kong Hee was afraid of being exposed for rigging Sun Ho's success".

 

"Kong's guilt should not be automatically imputed to others,” Chew said. Pointing to an e-mail Kong wrote to co-accused John Lam in January 2005, Chew said he had been "brainwashed" into supporting the Crossover Project as Kong regularly played up Ho's success.

 

"I thought she was a megastar,” Chew said. In reality, the church had bought up unsold stock of Sun's albums, the court heard.

 

"If this was a conspiracy, it is the worst thought-out conspiracy ever,” Chew said.

 

"It looks that way to me too,” Judge of Appeal Chao Hick Tin responded, prompting laughter from the public gallery.

 

The appeal continues on Friday afternoon, when Sharon Tan's case will be heard. "

I was going to rant about the corruption of the judges who stretched the trial forever and then gave so much leniency to the defendants, but I have a better idea.

 

I think it is better to consider this court the best the defendants could have had  (this makes the Singaporeans feel good...) and the fact that they were found guilty leaves no doubt that they are a bunch of CRIMINALS.  Their CRIMINAL mind explains their calling of innocent gays GUILTY OF SIN, an abominable slander that has no basis of reality.  In Christianity, we don't have outstanding moral leaders bashing homosexuals.  Jesus Christ never said a word against homosexuals.  Pope Francis is changing his church to a more accepting of homosexuals.  There are Saints for the workers, Saints for the poor, Saints for whatever, but there is no single Saint for the "fighters of homosexuals".

 

If I were a Singaporean, I would now without mercy rub in the face of the City Harvest Church the fact that they have NO moral standing because they were created by CRIMINALS and now are run by people WHO SUPPORT CRIMINALS.  So all their preaching against gays were done with CRIMINAL minds.

You may not know this, but over half of the US electorate voted AGAINST Trump, it's just that the screwed up electoral system gave the victory to him. 

So most Americans we ARE NOT xenophobic, and we have no choice but to live with the Trump!

 

But the people in your City Harvest Church HAVE THE CHOICE to go there, so they are all voluntarily HOMOPHOBIC.  What a pity!

You are quite ignorant about the political situation in the US.  There are investigations going on about the involvement of the Trump campaign with Russia, and there is great effort into finding grounds to impeach Trump.  In a country of laws like ours you cannot just make a revolution and overthrow him.

LOL!  I like the analogy with bee hives,  in this case better fitting than sheep who follow their shepherd. The bees may not be so dumb as sheep but they are genetically conditioned to work their wings off to serve the colony and their queen.  Maybe the nice Singaporeans are genetically conditioned to serve their oligarchy?  And their fantasy God?
