Indian High Court overturn colonial-era homesexual acts laws.

This is the same law that the British introduced to its colonies back in the 1800's. Britain itself removed such laws from her statutes in 1967 but her previous colonies in Asia including HongKong, India, Pakistan, Malaysia and Singapore retained it.

Hong Kong removed such laws in 1990, and today India removed it.

A friend commented a couple of days ago, perhaps in 10 years' time, Singapore will also removed it. I told him, I hope it will be in 5 years'time.

NEW DELHI —In a landmark ruling Thursday that could usher in an era of greater freedom for gay men and lesbians in India, New Delhi’s highest court decriminalized homosexuality.

“The inclusiveness that Indian society traditionally displayed, literally in every aspect of life, is manifest in recognizing a role in society for everyone,” judges of the Delhi High Court wrote in a 105-page decision, India’s first to directly address rights for gay men and lesbians. “Those perceived by the majority as ‘deviants’ or ‘different’ are not on that score excluded or ostracized,” the decision said.

Homosexuality has been illegal in India since 1861, when British rulers codified a law prohibiting “carnal intercourse against the order of nature with any man, woman or animal.” The law, known as Section 377 of India’s penal code, has long been viewed as an archaic holdover from colonialism by its detractors.

“Clearly, we are all thrilled,” said Anjali Gopalan, the executive director and founder of the Naz Foundation, an AIDS awareness group that sued to have Section 377 changed. “It is a first major step,” she said during a news conference in Delhi, but “there are many more battles.”

Thursday’s decision applies only in the territory of India’s capital city, but it is likely to force India’s government either to appeal the decision to the Supreme Court, or change the law nationwide, lawyers and advocates said.

Outside the hall where the Naz Foundation news conference was held, dozens of young men and women gathered to celebrate, along with a group of hijras, men who dress and act like women who classify themselves as belonging to neither gender. “It is a victory of human rights, not just of gay rights,” said one 22-year-old man who only identified himself as Manish.

Gay men and women have rarely been prosecuted under Section 377 in India in modern times, but it has been used to harass, blackmail and jail people.

Britain legalized homosexuality in England and Wales in 1967, but many of its former colonies, including Singapore, Zimbabwe and Malaysia, still retain strict laws against same-sex relations.

India’s family-oriented society is generally unwelcoming of homosexuality except in the most cosmopolitan circles. It is not uncommon for gay men and women to marry heterosexuals and have families, while carrying on secret relationships with members of the same sex.

In their decision, Chief Justice A. P. Shah and Justice S. Muralidhar declared Section 377, as it pertains to consensual sex among people above the age of 18, in violation of important parts of India’s Constitution. “Consensual sex amongst adults is legal, which includes even gay sex and sex among the same sexes,” they said.

The old law violates Article 14 of the Constitution, which guarantees all people “equality before the law;” Article 15, which prohibits discrimination “on grounds of religion, race, caste, sex or place of birth;” and Article 21, which guarantees “protection of life and personal liberty,” they said.

Acceptance of homosexuality has thawed somewhat in recent years in some urban areas. Gay pride parades in Indian cities last weekend attracted thousands of marchers, and several recent Bollywood movies, like Dostana, have included gay themes and characters, often played by Bollywood’s biggest heterosexual stars.

Still, the decision was condemned from many corners in India. “This is wrong,” said Maulana Abdul Khaliq Madrasi, a vice chancellor of Dar ul-Uloom, the main university for Islamic education in India. The decision bring Western culture to India, he said, will “corrupt Indian boys and girls.”

The High Court decision should be overturned, said Murli Manohar Joshi, the leader of the main opposition Hindu nationalist Bharatiya Janata Party. “The High Court can not decide all things,” he said.

The change comes after a decade-long, broad-based campaign organized by gay rights advocates, authors, celebrities, lawyers and AIDS awareness groups from around the world. India has one of the world’s largest populations of people with AIDS, and Section 377 was view by many advocates as a hurdle to education about safer sex.

Now that the High Court has ruled against Section 377, some say the next step is a change in the way that society views gay people. “The real problem is still the stigma attached,” especially outside big cities, said Ritu Dalmia, one of India’s best-known chefs, who lives with her girlfriend in Delhi.

Change particularly needs to happen in rural India, she said in an e-mail interview Thursday afternoon. “I have met women who were forced to sleep with men so that they could be ‘cured’ of homosexuality,” she said.

“Today is a historical moment where at least some tiny steps have been taken, but there is still a very, very long road ahead,” she said.

As India's High Court Mulls Reform, Nations Should Repeal This Legacy

December 17, 2008

(New York) - More than half of the world's remaining "sodomy" laws -criminalizing consensual homosexual conduct - are relics of British colonial rule, Human Rights Watch showed in a report published today. Human Rights Watch urged governments everywhere to affirm international human rights standards, and reject the oppressive legacies of colonialism, by repealing laws that criminalize consensual sexual activity among adults of the same sex.

The 66-page report, "This Alien Legacy: The Origins of ‘Sodomy' Laws in British Colonialism," describes how laws in over three dozen countries, from India to Uganda and from Nigeria to Papua New Guinea, derive from a single law on homosexual conduct that British colonial rulers imposed on India in 1860. This year, the High Court in Delhi ended hearings in a years-long case seeking to decriminalize homosexual conduct there. A ruling in the landmark case is expected soon.

"Half the world's countries that criminalize homosexual conduct do so because they cling to Victorian morality and colonial laws," said Scott Long, director of the lesbian, gay, bisexual, and transgender rights program at Human Rights Watch. "Getting rid of these unjust remnants of the British Empire is long overdue."

On December 18, 2008, the UN General Assembly will hear a statement signed by over 60 countries affirming that human rights protections include sexual orientation and gender identity.

Some national leaders have defended sodomy laws as reflections of indigenous cultures. Zimbabwe's Robert Mugabe, for example, has called gays and lesbians "un-African" and "worse than dogs and pigs." The Human Rights Watch report shows, however, that British colonial rulers brought in these laws because they saw the conquered cultures as morally lax on sexuality. The British also wanted to defend their own colonists against the "corrupting" effect of the colonies. One British viceroy of India warned that British soldiers could succumb to "replicas of Sodom and Gomorrah" as they acquired the "special Oriental vices."

In the early 19th century, the British drafted a new model Indian Penal Code, finally put into force in 1860. Section 377 punished "carnal intercourse against the order of nature" with up to life imprisonment.

Versions of Section 377 spread across the British Empire, from Africa to Southeast Asia. Through it, British colonists imposed one view on sexuality, by force, on all their colonized peoples. Over time, these laws came to seek punishment against not particular acts but whole classes of people. The British, for instance, listed "eunuchs" - their term for India's hijras, or transgender people - as a "criminal tribe" because they were prone to "sodomy." Simply for appearing in public, hijras could be arrested and jailed for up to two years.

Today, international human rights standards have compelled former colonial powers to acknowledge that these laws are wrong. England and Wales decriminalized homosexual conduct in 1967. The European Court of Human Rights found in 1981 that a surviving sodomy law in Northern Ireland violated fundamental rights protections. In 1994, the UN Human Rights Committee - which authoritatively interprets the International Covenant on Civil and Political Rights (ICCPR) - held that sodomy laws violate the rights to privacy and to non-discrimination.

The laws nonetheless persist in many of Britain's old colonial possessions. Moreover, the model British-era sodomy law made no distinction between consensual and non-consensual sex, or between sex among adults and sexual abuse of children. As a result, these surviving laws leave many rape victims and child victims of abuse without effective legal protection.

"From Malaysia to Uganda, governments use these laws to harass civil society, restrict free expression, discredit enemies, and destroy lives," Long said. "And sodomy laws add to the spread of HIV/AIDS by criminalizing outreach to affected groups."

Colonies and countries that retain versions of this British sodomy law include:

•In Asia and the Pacific: Bangladesh, Bhutan, Brunei, India, Kiribati, Malaysia, Maldives, Marshall Islands, Myanmar (Burma), Nauru, Pakistan, Papua New Guinea, Singapore, Solomon Islands, Sri Lanka, Tonga, Tuvalu, and Western Samoa. (Governments that inherited the same British law, but have abolished it since include: Australia, Fiji, Hong Kong, and New Zealand.)

•In Africa: Botswana, Gambia, Ghana, Kenya, Lesotho, Malawi, Mauritius, Nigeria, Seychelles, Sierra Leone, Somalia, Swaziland, Sudan, Tanzania, Uganda, Zambia, and Zimbabwe.

Eleven former British colonies in the Caribbean also retain sodomy laws derived from a different British model than the one imposed on India.

Just read a recent explanation from our indian minister that singapore will not be scraping section 377. it didn't come across to me as surprising at all. this section 377 plays very well with up-keeping "confucian values" which promotes the traditional nuclear heterosexual family. any politician would cling on tightly to section 377 to keep the population from shrinking further, and at the same time, import more foreign "talents" to fill the widening head-counts gap.

so i would suggest, keep fxxking guys, just do it behind closed doors and windows, and don't expect this section 377 to be lifted any sooner. :thumb:

不過，死者生前全身赤裸，加上手腳被電線綑綁，嘴巴又用襯衫綑綁著，側身臥躺在房內的床墊，以致現場傳出“窒息式性愛送命”的揣測。

死者為丁健國（50歲），生前在假日某廣場開設“TJ”美髮院，洋名約瑟。

死者美髮院員工今早受詢時說，常有孟加拉甚至澳洲籍男子前往美髮院找老板（死者），有時更看見孟加拉籍與老板“摸來摸去”，可是，他們都不敢過問老板的私生活。

與外籍男摸來摸去

他們說，這些外籍男子通常都是傍晚5至7時出現，等候老板一起下班。

死者的朋友鐘家華（55歲）也說，他經常勸死者少與身分不明的外籍人士交往，尤其死者經常在放工后，即攜帶美髮院收入約一兩千令吉在身，容易引起旁人的注意。

對于死者的斃命，死者的員工和友人皆感到駭然，難以接受事實。

昨晚死者屋友放工返回安樂市西林查14路住所，發現死者斃命在臥房內，其青色依絲華拉轎車也失蹤，立即報警。

努沙再也警區主任阿茲說，警方不排除謀殺可能性，死者可能遭綑綁而窒息，但也可能是心臟病猝死。

死者鄰居也指出，事發上午11時，曾看見一名疑是孟拉籍男子出現在死者屋子前院，死者住家鐵柵門和客廳門皆被開啟。

另一方面，努沙再也警區主任阿茲受詢時說，因受電流中斷影響，死者的解剖報告今日無法出爐。

他也說，警方正積極追查死者的死因，目前暫時沒有人被扣查。

顧客上門員工撥電尋人

美髮院老板遲未現身

女顧客一早預約弄頭髮，死者卻遲遲未現身，員工嘗試撥電卻無法尋獲老板“行跡”，相信死者當時已遇害。

美髮院員工林瑞祥（30歲）說，一般上，老板丁健國于上午11時便出現店裡，可是週六竟不見蹤影。

他說，下午3、4時，一名已預約美髮的女顧客上門，他們至少撥了兩通電話給老板，但手機無法接通，事后，老板也沒有回電，他們已感覺不尋常。

他指出，最后一次見到老板是聖誕節（即出事前一天）晚上8時45分左右，當時，老板還告訴他將到朋友家聚餐，並準備一瓶紅酒赴會；他離開時，店裡只剩老板一人。

店裡另一名員工說，死者非常善待員工，除了會和員工聊天，也不反對員工忙裡偷閒看電視。

他說，有一次他觀看電視重播《魔戒》，死者剛好返回店裡，看見電視播放不清楚，便特地買了全套的正版《魔戒》讓員工觀賞。

無家屬資料

盼親友與警聯絡

死者家屬未現身，屋友和員工皆不知死者親友聯絡方式。

據了解，死者生前雖喜歡與人聊天，卻甚少提起家事；他出事后，由于身邊的人皆無法提供警方資料，以致警方未能聯絡上死者親屬。

死者員工受詢時說，老板都把自己的重要資料鎖在專櫃，他們不敢私自開啟，希望通過媒體報導，讓老板的家屬親自與警方聯絡，並代為處理美髮院事務。

另有朋友鐘家華說，死者收藏許多寶石、鑽石和首飾，而且全收藏在住家。

不過，員工說，老板家鄉在霹靂實兆遠，今年12月，老板的母親二度致電到美髮院找老板；老板週末也常到新加坡探望堂姐或表姐。

據林瑞祥了解，老板從小受英文教育，近年才學講華語，生前有一名哥哥在倫敦從事美髮工作，另有弟弟在2年前于家鄉想開店做生意，老板曾在經濟上給予援助。

他說，假日廣場現有逾20間美髮院，老板的美髮歷史最悠久，不少學生也在廣場內開店與他“打對台”，可是老板從不因此而生氣，性格開朗的他還常與同業打招呼。

苦等9年買公寓,

未遷入已出事

死者苦等9年買公寓，卻來不及遷入，其新居更被指風水位有問題。

美髮院員工指出，死者在拉慶買了一間公寓，並聲稱這間公寓讓老板等了9年，終于如願購得。

他說，由于老板急著搬入新居，近期較少回美髮院，除了催促承包商盡快完成新居裝修工作，也常到新居監督工程進展。

他也說，老板曾提及，新居廚房風水出現問題，爐灶和水的位置相衝，他更為此重新裝修爐灶格局，沒料到最終還是出事。

員工也說，老板非常注重飲食，除了喜歡吃咖哩，平常都吃得很健康，最近更開始茹素，沒聽說老板患有心臟病。

彰化縣一名男子日前因感冒在家休息，他認識五天的男網友帶飲料到家中探病，還好心對他說：「感冒要多喝水才會好！」男子喝下紅茶後不省人事，醒來發現自己全身赤裸，肛門腫痛，地上有疑似沾精液衛生紙，懷疑遭男網友下藥迷姦，他到醫院驗傷後報警。

警方說，自稱非同性戀者的被害陳姓男子（二十八歲）未婚，目前在餐飲店當服務生；指控迷姦他的男網友，是自稱就讀彰化一所大學的李姓男生（十八歲，台南人）。

警方調查，陳男和李男在本月七日於網路ＵＴ聊天室認識，期間曾四次約在北斗鎮的網咖店和咖啡店碰面聊天，十二日中午，陳男感冒在家休息，李打電話稱要來探望他，陳即騎車去載李來家裡。

陳男說，當天父母在一樓客廳看電視，他還向父母介紹李是剛認識的友人，接著兩人到二樓房間聊天，李擺出一副很關心的神情，還問他病有沒有好一點，並說：「感冒要多喝水，這樣才比較快好！」接著拿出一杯紅茶請他喝。

陳男表示，他喝下飲料後，昏睡五個多小時，傍晚醒來，發現自己一絲不掛躺床上，並感覺肛門腫痛不堪，地上有一團疑似沾有精液衛生紙，和沒喝完的紅茶。陳說，他才喝紅茶幾口，覺得味道怪怪的，因李稱已喝完一杯，他才繼續喝，他懷疑李在飲料下藥後對他肛交，當晚到醫院驗傷後，持飲料、衛生紙向警方報案。

JOHOR BARU: The hairstylist who was found dead - naked, bound and gagged - died of heart failure brought upon by excessive excitement during an unnatural sex game.

Nusajaya OCPD Supt Abdul Aziz Ahmad said the post-mortem showed that Tang Kin Kok, 49, had internal bleeding that could have been caused by sexual stimulation.

He added that the victim also had multiple signs of penetration in his anus.

"The heart failure could have been triggered as the victim became too excited when committing unnatural sex," Supt Abdul Aziz said yesterday.

He said that while the post-mortem showed no criminal element leading to the death, police had identified a few of Tang's male acquaintances to help in the investigation.

"We are going to detain them soon," he said, adding that anyone who knew the victim was encouraged to come forward.

Supt Abdul Aziz urged anyone with information to contact the police hotline at 07-2212 999 or the nearest police station.

Tang's body was found by a housemate in his room at a rented house in Bandar Selesa Jaya around 9.50pm on Saturday.

and 1011 mean = prefer 1 for most of the time

I think that comes from a convention among the Chinese-speaking gay, where number 0 (ling hao) means bottom and number 1 (yi hao) means top.

I don't think Mr xyz is simply to choose the most handsome guy in the universe. It is probably to choose the most charming contestant and charm need not be all about looks. The courage, which your so-called handsome guys probably lack, to step on the platform and showcase one's body to the world is probably one of the elements that make one looks charming.

Minimum height requirement of 5’7” or 170cm

No previous criminal record (Not any A or B on the strett can join, later turn out like Ms Low ho Credit Card criminal)
