Guest Guest Posted June 30, 2013 Report Share Posted June 30, 2013 A woman who spent $380,000 over ten years buying hair care packages has sued Yun Nam Hair Care to seek the refund of the unused portion of the packages amounting to more than $350,000. Yun Nam Hair Care claims that the customer had purchased the packages voluntarily and has denied all of her allegations. The plaintiff, Lam Ngiet Keow, 58, a retiree, lodged a suit against Yun Nam Hair Care Pte Ltd with the High Court on 25 April, seeking $353,897. Yun Nam Hair Care has denied all of the allegations made by Madam Lam. According to Madam Lam, she had bought 40 package contracts from the company since 2003, paying a total of around $380,000. However, she has yet to utilise the equivalent of $353,897 of the packages to date, the majority which was purchased between June 2011 and October 2012. According to Madam Lam, she underwent a free trial treatment at the Suntec branch of Yun Nam Hair Care between November and December 2003 and subsequently purchased six packages worth over $2,000 to treat her grey hair. She said that the hair care centre used hard-sell tactics to get her to buy additional treatment packages between March 2004 and October 2012, even though she had not used up the treatment packages she had bought. She claims that the hair consultants working for the hair care centre had misled her into believing that the treatments offered could help her solve her grey hair problem even though there was no scientific basis for this. They had told her that the treatments involved no risk but did not allow her to cancel or transfer the balance of her original treatment packages when she purchased new ones. She also alleges that the hair care centre, despite knowing that she had no need for such treatments, had recommended her to buy treatment packages that could not be used up even in 44 years. Defence says plaintiff was aware that there was no guarantee of any specific results In its defence, Yun Nam Hair Care said that Madam Lam had signed up for a free trial at its Suntec outlet on 18 November 2002 and had subsequently bought a package to treat hair loss, grey hair, dandruff and oily scalp. It said that Madam Lam had made an informed decision in voluntarily buying the packages; she understood that the packages were beauty products and that the therapeutic outcomes could differ among individuals, and thus, the company could not guarantee any specific results. In addition, it also said that Madam Lam was aware that the treatment could lead to scalp irritation, discomfort and other consequences. Doctor wanted plaintiff to stop treatment; had referred her to skin centre for check-up Yun Nam Hair Care said that its customers are not entitled to any refund should any packages be terminated after being bought. However, the balance of the packages could be exchanged for other home care products. Madam Lam had claimed that starting from August last year, she had visited Tampines Polyclinic for itchy scalp, dizziness and dandruff. The doctor had asked her to stop all treatment and had referred her to the National Skin Centre for an examination. She said that during that period, two hair consultants by the names of Angie and Peggy had asked her to give Yun Nam Hair Care one last chance and had assured her that her hair problems could be effectively treated with two new treatment packages. However, her hair problems remained after she bought these packages. In its defence, Yun Nam Hair Care said that its treatments are all carried out by trained and qualified consultants and its products are registered under the Health Products Act. It denied that the company or the consultants named by Madam Lam had deliberately misled her into buying treatment packages. It denied all her allegations and did not feel that she had any grounds to seek compensation for any injuries or damages. The case is currently in pre-trial conference. I'm a customer of Beijing101 & so far I had resisted all their tactics, however older folks are not able to handle such situations, like my mum she signed up for a 10x $5k facial package. YN is not the 1st one, I remember some years ago, it was Svenson. The gov came out and advised pple to 'open their eyes big big' before they commit these deals. Sporeans are one of the more exposed people (to various media) in the region, but these pple behave in a most st*p*d way I can think of.Don't give st*p*d excuses like they are old and cannot take hard tactics, these consumers are in their 50s and 60s; they are not so uneducated as u want to believe they are. Emotional-blackmail may be contemptible, but it's one of the most effective and often-used.Flirting, is often used to sell "pink" merchandise. I don't know how she got sold, but everyone has their own weaknesses and weak moments, and had fallen prey to sales tactics at some point, whether they know it or not. Do you know how many tens of branches Yunnam hair centers, Beijing 101 hair centers, Glower hair centers, Trichokare hair centers, and recently Lao Fo YE hair centers there are. Multiply by ten to twenty people employed by these places they p[rovide employment to lowly educated people hor. Close them down these people will have to look for new jobs . The upper class do not focus on doing work to bring home the money, they depend on investments, trading and speculation etc.These group of people spend money on a scale totally unacceptable to the common mass. They will offer free trials... and once you are there, they will try their best to convince you to buy packages.. Most of us will feel shy to say " No", especially after a free trial...and that's how it starts...So best is to avoid these so called " free trial" or good discounts offered by groupon or deals.sg....unless you can resist their hard sellings and walk out... Anyway, you will be disappoint with the result...but some still sign up...maybe because they give people some " hope" ??? Also I noticed that once you signed a pack, you will not be their preferred customers ( yes, don't think that, after signing a package, you are their preferred cust.i.e. priority cust.). This is because you already given them your money so they will focus on those that hasn't signed up. Similar cases to foot reflex..ie. wanyang, chenkang...etc. I noticed this when I was at wanyang. They given priority to those without packages...This is my experience... Sad right...but this is the hard truth.. Bottomline, I don't trust any of these slimming or hair centres... they r just there to get your money.....Even the so called 'clinically proven" regaine is not as good as you think... Initially was ok, they check my hair and told me the problem. After that, the lady took out a file and introduce me the packages, all the packages are not cheap. She keep on introducing the packages without stop. To escape, i had to tell her, i didn't bring enough cash and i don't have credit card. She insist i can pay a deposit and come back the following week to settle the remaining. Think i paid 300 plus as deposit and went thru 1 treatment. She also want me to sign a form declaring that i was NOT force to buy the packages. Under that circumstance, have no choice but to sign. I was quite happy and relief that i can leave the place. The 300 plus, had to treat it as 破财消灾。。。 From that day onwards, never dare to go any of this hair center. 1 experience is already enough.... I just stick to the basic package. Anyway, grey hair takes time to improve and I saw the improvement. Just be firm and be clear what u want. Do you mind telling us your age, i am 47 years old, young looking, face is relatively wrinkle free, have a full head of hair , no signs of mediterranean type male pattern baldness, have a lot of gre hair, throughout my head scalp, mainly concentrated on the crown area, have been dyeing my own hair for the last 6 years at least, have noticed that may hair grow out pretty fast, so the grey roots show up in a matter of days after i dye my hair, how can yunnan help my case does having too much sex cuase grey hair to speed up.
