This comes just two months after it was rapped by the city’s consumer watchdog for using intimidation and misleading sales practices on customers. The firm – formally known as JV Fitness and which also trades as mYoga and Leap – said in a statement: “The company is currently in negotiation with potential buyers for the acquisition of its business or shareholdings.” Top gym chain California Fitness in trouble again after customer allegedly tricked into HK$140,000 payment It assured customers that operations would carry on as normal “until further notice”. A High Court document on Tuesday showed the petition was filed by BeSpark Technologies Engineering, solely owned by Wong Ping-kuen, who until May was a JV Fitness director. The amount that JV Fitness, one of the city’s biggest gym operators, owes the creditor is not immediately known, but a hearing date has been scheduled for August 31. California Fitness, which opened its first gym in Hong Kong in 1996, currently has nine branches in the city and 15 centres across Asia. While mYoga boasts two branches, Leap, a community version of California Fitness, has one. An investigation by the South China Morning Post reveals that four directors – Wong, Cheng Wai-hong, Cheng Kar-tat, and Chan Wai-man – departed one after another between April and May. The Company Registry shows that Wong joined as a director in December last year. In April, California Fitness was publicly named and shamed by the Consumer Council. The council said the number of complaints lodged against the fitness chain increased by 30 per cent to 296 cases in 2015. The figure accounted for 51 per cent of all complaints the council received. Among them, 22 cases involved over HK$100,000 each, and in one case HK$570,000. Hong Kong Consumer Council names and shames California Fitness for aggressive sales practices The council said earlier that half of the complaints against the gym chain were lodged by new members who claimed they were pressured or misled into signing membership agreements, with one of the most common practices being lucky draws or free trials. Customers would then face hard-sell tactics or be lured into providing their bank card information for transactions without their consent, the council alleged earlier. California Fitness was also earlier under fire for allegedly forcing a mentally challenged man to pay for fitness courses and take out loans totalling HK$90,000. Barrister and lawmaker Dennis Kwok warned that if the chain went bankrupt, gym-goers might lose their membership fees. “General customers come last,” he said, of the aftermath of a winding-up order being granted. A source told the Hong Kong Economic Journal that the group has been talking with the company since three weeks ago to acquire its businesses in Hong Kong and the mainland. It has offered HK$100 million (US$12.89 million) for the deal. Negotiations are now in the final stages, the source said, adding that both sides were set to meet again on Wednesday afternoon. Bryan To, owner of FFG Martial Arts & Fitness Center who the source said is the leader of the group, declined to comment on the rumor. But California Fitness, which JV Fitness operates along with nine other fitness clubs in Hong Kong, has confirmed that talks about an acquisition or stake sale with some potential investors are going on. According to the source, the investor group will not make the acquisition in the name of FFG but it is likely to resell the acquired businesses to FFG in the future. In April the Consumer Council reprimanded California Fitness after its marketing staff were accused of intimidating and misleading customers to sign up for membership and high-priced private lessons. Aside from California Fitness, JV Fitness also operates yoga club mYoga and Leap fitness centers. It has 12 branches in Hong Kong, and runs several units in Beijing, Shanghai and Guangzhou. Details of the writ of liquidation filed by BeSpark Technologies Engineering are not clear, but a hearing has been set for Aug. 31. Businessman Wong Ping-kuen is a major shareholder of the engineering company and was a board member of JV Fitness until he resigned in May. California gym here is famous for their hardsell and unscrupulous tactics too. I'm sure spf is sleeping on their job again in this case, especially when it's a mega gym this time. Imagine assembling a 100 officer team just to raid their hq in novena due to all the well built personal trainers there. Customs arrested a 57-year-old man, a company secretary, and a 45-year-old woman – a manager. They are suspected of failing to provide services to customers who had paid for fitness club memberships and personal trainer sessions. California Fitness has been mired in controversy since the indefinite closure of its Whampoa branch last month. A liquidation request is being launched against JV Fitness, which operates the chain. The two arrested individuals have been released on bail pending further investigation. According to a government press release, the maximum penalty for violating the Trade Descriptions Ordinance is a fine of HK$500,000 and imprisonment of five years. Lawmaker Tang Ka-piu, who represents the Labour functional constituency, convened a meeting of around 300 California Fitness staff on Sunday to discuss an action plan against the gym chain. Concern groups such as the Hong Kong Recreation and Sports Professional General Union and the Hong Kong Beauty and Fitness Professional General Union were present at the meeting. After the meeting, Tang said that staff at the troubled gym chain have decided to issue a public letter demanding that California Fitness provide answers regarding the staff’s overdue wages, the company’s financial condition and its future course of action within 48 hours. The Labour Department said that investigation regarding cases of overdue payment at fitness centres under JV Fitness is still ongoing. For the trainers, if they are not employees, but freelancers, then too bad, they rank with other unsecured creditors. If the company has huge liabilities to other parties, then the pro rata portion going to small time creditors will be hardly anything. A source showed the Post a notice dated July 12 informing staff that all outlets under JV Fitness, which runs 12 gym centres under the three companies, would cease operations effective on Tuesday until further announcements. Two California Fitness senior executives arrested on suspicion of flouting Hong Kong’s trade descriptions law The notice said operating capital had been frozen in light of a pending winding-up petition and the group would have to close business because it was short of cash. “Should there be new updates, the group will make public announcements,” it said. Since its Whampoa outlet closed last Monday, California Fitness has been hit by more trouble, putting what the Postunderstands to be 100,000 members and 500 employees in limbo. An employee who spoke on condition of anonymity said: “So many colleagues are going back to the gyms to pick up their stuff.” Local media reported later in the night on Monday that the same notice had been posted at the gates of some branches. I was cornered in a L-shaped sofa by 2 persistent staffs who spent 1 hour to brainwash me. They say they will give me 13 months (1 month Groupon + 12 months package) for the price of 8 or 9 months (forgot how many already) but in the end I only got 12 months. They conveniently forgot about the 13th month. They also forced me to sign up for personal trainer. That very day I paid around $2000. My mum was furious when she found out and nearly had a nervous breakdown. In the 12th month they ask me whether I want to renew. I said no. A few weeks later, CF Orchard branch closed down. And now this (the HK saga) happens... Luckily I didn't renew. Although the facilities and group classes are good, the mental stress on the 1st day and the guilt for the next 1-2 months still haunt me until today. I can say that Cali Fitness finally gets its karma for its aggressive and dishonest practices. If you show them you have only $30 in your wallet, they should leave you alone. Personal experience.. I was conned (by an ex-colleague) to get a free beauty/slimming consultation by Expressions Dhoby Ghaut some ten years ago. She wanted to boost her sales figures and I only agreed to help her once. At the shop, the staff-in-attendance tried to "persuade" me to buy 20 sessions of slimming when I was in my underwear. That was really awkward, right? A charbo trying her best to sell the product while I was semi-naked. Good thing I am gay ..(if not, she might throw herself at me...). That day, I left my wallet at home so the damage was ZERO. You are not three year old. Can just say no. Don't have to keep credit card at home what if you need the money? So many gay men are also yes men nowadays. They purposely talked to you while you were naked so you would feel pressured to close the deal as you are anxious to put on clothes cos you are embarrassed as you are gay and she know that.
